CONDITIONS OF USE OF FijoVirtual

  • READ CAREFULLY BEFORE USING THE PRODUCT(S) OR WEBSITES OF FijoVirtual

Main Points:
It is important that you read and understand this document in its entirety. However, there are some main points we wish to emphasize:

  • YOU DO NOT HAVE ACCESS TO EMERGENCY SERVICES. 
  • DOES NOT EXERCISE OWNERSHIP OVER THE NUMBERS. The number assigned by FijoVirtual does not become your property. You may not transfer or attempt to transfer your number to any other person or operator. You must ensure that you meet all assignment requirements that appear when purchasing the number, otherwise the number may be withdrawn. Please also see the “Specific Product Conditions” paragraph.
  • THE FijoVirtual CREDIT IS INACTIVE AFTER 365 DAYS. If you purchase FijoVirtual credit, you must bear in mind that it expires permanently (is lost) after 365 days of inactivity. 
  • IF A FijoVirtual NUMBER HAS NOT BEEN RENEWED AFTER 5 DAYS, we will cancel the number. Renewal takes place automatically if there is enough credit in your FijoVirtual account.
  • IF YOU HAVE A BALANCE IN YOUR ACCOUNT LESS THAN WHAT WE INDICATE (DEPENDS ON THE NUMBER) YOU WILL NOT BE ABLE TO RECEIVE CALLS OR MAKE CALLS FROM YOUR Virtual Landline.
  • AFTER 6 MONTHS CONTINUED WITH A BALANCE LESS THAN €1 in your virtual landline account YOUR NUMBER WILL BE CANCELED automatically due to inactivity.
  • These conditions of use are also valid for cases of portability of a number that you have with another operator and that you want to migrate to FijoVirtual.
  • FijoVirtual is a prepaid service, that is, even if you have renewed the virtual landline, if you do not have a balance, you will not be able to receive calls. Your balance must always be greater than one euro (minimum amount required) to be able to receive calls. The virtual landline is not responsible for notifying you when your balance is low.
  • Fixed virtual is not responsible for the use that you give to the virtual number, if you use it for business FijoVirtual does not share your losses or profits that your virtual number helps you obtain, Fixed virtual simply gives you a service for an agreed payment, if you have a problem with the virtual number you must report that problem, if you do not report it we understand that your number works correctly.
  • CALLBACK / RETURN CALL IS PROHIBITED: Numbers cannot be used for call-back systems, traffic springboards, or equivalent mechanisms.
  • KYC/AML, identity verification and local requirements: Before activating the service, during the registration process or during the provision of the service, FijoVirtual may require documentation of verification of identity, ownership, address, representation, activity or regulatory compliance. This documentation may include DNI/NIE, passport or equivalent document, utility bill, proof of address, company/self-employed documentation, authorization of representation or passing an additional KYC process. The lack of contribution, incomplete contribution or the existence of inaccurate, inconsistent or non-verifiable data may imply the rejection of registration, the suspension of the service, the withdrawal of numbering or the termination of the contractual relationship.
  • Changes due to regulation/wholesale: Prices and availability may vary due to regulatory changes, interconnection or wholesale costs.
  • FijoVirtual may reject a client request or order: i) if the information provided is incorrect. ii) si have reason to doubt the accuracy of the information, or whether it is not supported by the required identification or, in the case of business requests, by the required authorization. iii) If the Client is known to have committed fraud, is bankrupt or has given reason to doubt its ability to fulfill its commitments under this Agreement. In this case we do not have to provide explanations or proof.

 1. YOUR CONTRACT WITH FijoVirtual

  1. FijoVirtual provides to you any additional products or features, or other “FijoVirtual” branded products, for which you are required to pay (including any products or features that are available free of charge on a trial basis only) (“Non-Free Products“).
  2. FijoVirtual operates the FijoVirtual websites www.fijovirtual.com  (“FijoVirtual Website(s)“).
  3. FijoVirtual” refers to FijoVirtual, telecommunications operator, Ricardo Alberto Petrucci X7505785B, Constitución 108, 08014 Barcelona.
  4. Products“collectively refers to the Free Products and the Non-Free Products.”You” or “his/hers” means you, the registered owner of the User Account and the licensee under these Terms.
  5. Your contract with FijoVirtual is made up of the clauses and conditions set out in this document. If there are discrepancies between the Additional Conditions and this document, this document will prevail.
  6. Part of the infrastructure, numbering, termination, origination, SMS, portability and other technical services may be provided directly or indirectly through wholesale providers, carriers, local operators or external platforms, including, among others, DIDWW, Telnyx or other equivalent providers.
    When the contracted service depends totally or partially on said providers, the technical, regulatory, numbering, portability, acceptable use, fraud prevention, KYC/AML, local requirements by country, traffic restrictions, documentation obligations and compliance policies required by said providers and/or by the operators or competent authorities of each jurisdiction will be applicable and binding for the client.
    In particular, the client accepts that the use of numbering or services in certain jurisdictions may require the provision of additional documentation, such as DNI/NIE, passport, equivalent identification document, service invoice, proof of address, business documentation, proof of activity, authorization of representation or passing additional verification/KYC processes.
    FijoVirtual may reject, suspend, limit, withdraw or cancel the activation or use of numbering or services when the client does not meet said requirements, when the wholesale supplier or local operator rejects validation, when there is a regulatory requirement, when inconsistencies are detected in the documentation or when there are indications of fraud, misuse, anomalous traffic, impersonation or non-compliance with the applicable conditions.
    The client must consult and comply, when applicable, with the conditions, policies and regulatory requirements published by the suppliers used to provide the service, including the terms, agreements, acceptable use policies and country requirements of DIDWW, Telnyx or other suppliers that may intervene in the provision of the service.

2. ACCEPTANCE OF THE CONDITIONS

  1. In order to use the online application, the Products or the FijoVirtual Websites, the user must first accept these Conditions. You accept these Terms (a) when you click to accept the Terms; or (b) when you use the application, Products or FijoVirtual Websites. We recommend that you print a copy of these Terms for your review.
    By accepting these Conditions, contracting, registering, requesting registration, placing an order, activating a service or using the FijoVirtual Products, you declare that you have read and accepted these Terms and Conditions, as well as having been informed of the processing of your personal data in accordance with our Privacy Policy, available at:

  2. You cannot accept these Terms if: (a) you are not legally entitled to use the FijoVirtual Software, Products or Websites in the country in which you reside, or (b) you are not of legal age to enter into a binding contract with FijoVirtual.
  3. In some countries, the Products may be provided by a local FijoVirtual partner. In such case, that local partner will ask you to accept its own terms of service (“local terms”). If there is a discrepancy between local conditions and these Terms, the local conditions will prevail with respect to such discrepancy.

3. MODIFICATIONS MADE TO THE CONDITIONS

  1. Occasionally and without prior notice, FijoVirtual may modify these Conditions. Modifications to the Additional Conditions will be published on the corresponding FijoVirtual Website. The modifications will come into effect upon publication. You are obliged to consult the Conditions periodically. You understand and agree that your express acceptance of the Terms and your use of the FijoVirtual application, Products or Websites after the date of posting will constitute your agreement to the updated Terms. If you do not accept the modified Conditions, you may terminate your relationship with FijoVirtual in accordance with the provisions of this agreement. Changes imposed by law or security may be applied immediately. Adjustments derived from wholesale carriers or regulators.

4. LICENSE

Limited license. Limited, non-exclusive and non-transferable license to use the application and services. Subject to your compliance with these Conditions, you are granted a license to FijoVirtual (username and password).  FijoVirtual reserves all rights not expressly granted in these Conditions.

  • Restrictions. You may NOT and agree NOT to do the following:
  1. Sublicense, sell, assign, rent, lease, export, import, distribute or transfer or grant rights to any third party in the Software or Services.
  2. Make, cause, permit or authorize the modification, creation of derivative works or improvements, translation, reverse engineering, decompiling, disassembling, decoding, emulation, discovery, or intent to discover the source code or protocols of the application or any of its parts or features (except to the extent permitted by law).
  3. Remove, hide or alter any copyright notice or other proprietary notices included in the application.
  4. Use the application or cause the application (or any part thereof) to be used within commercial services or products or use it to provide such services or products to third parties. The foregoing does not prevent you from using the application for your own business communications, subject to Section 4.1 above;
  5. Third party technology. If you are using Software preloaded, incorporated, combined, distributed or used with or downloaded from third party products, hardware, software applications, programs or devices (“Third Party Technology”), you acknowledge and agree that: (a) you may be required to enter into a separate license agreement with the applicable third party owner or licensor for the use of such Third Party Technology; (b) some Products or functionality may not be available through Third Party Technology, and (c) FijoVirtual cannot guarantee that the Software will always be available on or related to such Third Party Technology.

5. USE OF THE APPLICATION, PRODUCTS AND WEBSITES OF FijoVirtual

  1. Team. In order to use the web application, you will need a broadband Internet connection. It is your responsibility to provide all equipment necessary to access the Internet and set up communications. The Service depends on third parties (operators/carriers/suppliers). Operation is not guaranteed uninterrupted nor error-free; We will apply reasonable efforts for continuity and resolution of incidents.
  2. Using your equipment. The Internet Communications Software may use the processing power, memory and bandwidth of the computer (or other applicable device) you are using, for the limited purpose of facilitating communication and establishing connection between users of the Internet Communications Software. If your use of the Internet Communications Software depends on the use of a processor and bandwidth owned or controlled by third parties, you acknowledge and agree that your license to use the Internet Communications Software is subject to your obtaining the consent of the applicable third party for such use. You represent and warrant that by accepting these Terms, you have obtained such consent.
  3. Software Updates. You may be required to enter into a more current version of these Terms in order to download or take advantage of any Updates. FijoVirtual is not obligated to provide any type of Updates. However, from time to time FijoVirtual, in its sole discretion, may require you to automatically download and install Updates to enable you to use the Software and accept the Updates subject to these Terms.
  4. Suspension, technical improvements and maintenance. From time to time, FijoVirtual may need to update or maintain the FijoVirtual application, Products or Websites or the underlying infrastructure that allows you to use the FijoVirtual application, Products or Websites. This may require FijoVirtual to temporarily suspend or limit your use of part or all of the FijoVirtual application, Products or Websites until such maintenance or update can be completed. To the extent possible and unless urgent intervention is required, FijoVirtual will publish the time and date of such suspension or limitation in advance on the FijoVirtual Website. You shall not be entitled to claim damages for any such suspension or limitation of use of any FijoVirtual Software, Product or Website.
  5. You do not have access to emergency services. Neither the Products nor the application are intended to support emergency calls to any type of hospital, law enforcement agency, healthcare unit or any other type of Emergency Service, and should not be used for that purpose. You acknowledge and agree that: (i) FijoVirtual is under no obligation to provide access to Emergency Services under any applicable local or national law, regulation or rule; (ii) you are responsible for purchasing, other than the Products, traditional landline or wireless (mobile) telephone services that offer access to Emergency Services; and (iii) the Software and Products are not a substitute for your primary telephone service.
  6. The following are prohibited: non-consensual spam/telemarketing, illicit content, defamation, fraud, impersonation, use contrary to third-party rights or applicable regulations. Forbidden: (i) callback; (ii) auto dial massive without legal basis; (iii) campaigns without consent; (iv) anomalous or artificial traffic; (v) use that violates local regulations (consumers, commercial communications, etc.).
  7. Content of communications. FijoVirtual does not provide, control in any way, monitor or take responsibility for the content of communications made through the Software or Products offered. By using any of the products, you agree that any content you submit will be transmitted to the recipient of your communication. The content of the communications is the entire responsibility of the person who originated it. As a result, you may be exposed to content that is offensive, illegal, harmful to minors, obscene, indecent or otherwise objectionable. The content of communications may be protected by intellectual property rights, which belong to third parties. You are responsible for the content you choose to communicate and access through the products. In particular, you are responsible for ensuring that you do not submit material that (i) is proprietary, protected by trade secret, or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from the legal owner; (ii) is a falsehood or fraudulent statement; (iii) is offensive, unlawful, harmful to minors, obscene, defamatory, libelous, threatening, pornographic, harassing, aggressive, ethnically offensive or racist, or incites conduct that could be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) is an advertising notice or offer of services; or (v) attempts to impersonate another person. FijoVirtual reserves the right (without any obligation) to decide whether any type of content you use complies with these Conditions. FijoVirtual may, in its sole discretion, remove such content or terminate these Terms and your User Account if you use any content that violates these Terms.
  8. Notice and removal. If FijoVirtual is notified that any material you submit, upload, modify, organize, share or publish on the FijoVirtual Website or through the Software or products (excluding your private communications) (“User Submissions”) is inappropriate or infringes any third party right, or if FijoVirtual wishes to remove the User Submission for any reason, FijoVirtual reserves the right to automatically remove the User Submission for any reason immediately or within such other performance deadlines as it may provide. FijoVirtual decides at its sole discretion. The User Submission will be removed without any acknowledgment of liability and without prejudice to any right, legal remedy or defense, all of which are expressly reserved. You acknowledge and agree that FijoVirtual has no obligation to replace such User Submission at any time. If User Submissions do not comply, or you believe that they do not comply, with any of your rights (including intellectual property rights) or are illegal, please contact us immediately in accordance with our notice and takedown procedure.
  9. Quality. FijoVirtual cannot guarantee that the FijoVirtual Software, Products or Websites will operate without interruptions, delays or errors. A variety of factors may affect the quality of your communications and the use of the Software, the Products (depending on the Products used) or the FijoVirtual Websites, virtual numbers, virtual SMS or virtual fax, and may cause the failure of your communications, including, but not limited to, the following: your local network, firewall, your Internet service provider, your mobile network in case of detours to mobile phones, your mobile or fixed data network, the operator of the person of origin of the call or message, the public Internet, the public switched telephone network and its power source and a long etc. FijoVirtual will not be responsible for any difficulty, interruption or delay caused by failure or insufficiency in any of these items or any other item over which we have no control.
  10. Product Modifications. FijoVirtual constantly improves the Software and Products, and may also occasionally need to change technical characteristics, in order to comply with current regulations. Consequently, the user acknowledges and accepts that the Products and the functionality of the Software may change from time to time. If you do not accept any of the modifications made to the Software and Products, you may terminate your relationship with FijoVirtual in accordance with the provisions of this contract. Additionally, the user acknowledges and agrees that certain Products may be subject to usage limits or geographic restrictions, which may vary from time to time. For details on the most up-to-date usage restrictions that apply to the Products you are using, please visit the FijoVirtual Website.
  11. Unsolicited ideas. FijoVirtual does not consider or accept unsolicited ideas or proposals, such as, but not limited to, ideas for new products, technologies, promotions, product names, product comments and product improvements (“Unsolicited Comments”). If you submit Unsolicited Feedback to FijoVirtual through the FijoVirtual Website or otherwise, you acknowledge and agree that FijoVirtual shall not be obligated to maintain confidentiality with respect to the Unsolicited Feedback.
  12. Reports. Certain parts of the FijoVirtual Websites or the Software may request written suggestions or problem reports, such as using our contact form or problem report form (“Reports”). Please read carefully any specific conditions governing these Reports. The Reports will be considered property of FijoVirtual. FijoVirtual will exclusively own all current or future rights to the Reports in perpetuity and will have the right to use the Reports for any purpose (commercial or non-commercial) without obligation to provide compensation to the provider of the Reports. Under no circumstances will the Reports you send to FijoVirtual be treated as confidential nor will FijoVirtual be responsible for the disclosure of said Reports.
  13. Likewise, FijoVirtual reserves the right to offer the sale of value-added services charged to the same FijoVirtual account (SMS, Mobile Recharge, Prepaid Cards…) always with the express consent of the user.
  14. Linking. You may link to the FijoVirtual Website from another website you own, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on the part of FijoVirtual where none exists. You must not place the Site within the frame of any other site. FijoVirtual may revoke permission to link to the FijoVirtual Websites at any time, in its sole discretion, and will notify you thereof.
  15. The FijoVirtual website has been prepared in good faith by FijoVirtual with information from internal and external sources of the Company. Despite this and due to the large amount of information it contains, its total and complete exhaustiveness and accuracy cannot be guaranteed and, in particular, we must warn that the information contained therein could be, in some isolated cases, incomplete, contain errors or be outdated. Consequently, before taking any initiative or action derived from its content, the information obtained through this Website must be verified by contacting FijoVirtual.
  16. The number is assigned for use during the term of the service and does not imply transfer of ownership. It can be withdrawn due to documentary/regulatory non-compliance, non-payment or inactivity. Portability subject to regulations and valid documentation. We may request documentation KYC/AML and documentation required locally (e.g. proof of address in the country of the number). We do not allow callback with the assigned numbering.

  17. Additional verification and correct use of the service. FijoVirtual may request additional documentation from the client at any time during registration or during the validity of the service when there are reasonable reasons, internal security controls, wholesale supplier requirements, regulatory requirements, inconsistencies in the data provided, signs of misuse, anomalous traffic, fraud, identity theft, non-payment, claims or any circumstance that may affect the security, legality or correct provision of the service.
    The documentation requested may include, depending on the case, DNI/NIE, passport or equivalent document, recent utility bill, document proving domicile, commercial or tax documentation, authorization of representation, proof of activity or passing an additional identity verification/KYC process.
    If the client does not provide the requested documentation within the indicated period, or if the documentation provided is insufficient, false, inaccurate, illegible or does not allow the verification to be completed, FijoVirtual may reject the registration, temporarily suspend the service, limit functionalities, withdraw the assigned numbering or terminate the contractual relationship, without prejudice to the amounts already accrued and the applicable legal obligations.

6. YOUR OBLIGATIONS

User account. Before you use FijoVirtual’s services, products or software for the first time, you will be asked to create a User Account and choose a username and password. We recommend that you choose a password that is difficult to guess and contains letters, numbers, and symbols. You will only be able to access its services through said username and password. You are solely responsible for all activities carried out through your User Account. To prevent unauthorized use, you must keep your password confidential and may not share it with third parties or use it to access third-party websites or services. If you suspect that someone else knows your password, you should change it immediately in order to protect the security of your User Account. It is your responsibility to ensure that you do not respond to any unsolicited requests for credit card information or other data. FijoVirtual is not responsible if you do not comply with the obligations established in this paragraph.

  • Lawful use. You must use the FijoVirtual Software, Products and Websites in accordance with the laws in force where you reside. It is your responsibility to ensure that where you reside you are legally permitted to use the FijoVirtual Software, Products or Websites.

Prohibited use. You cannot:

  1. intercept or monitor, damage or modify any communications that are directed to you;
  2. use any spider, virus, worm, Trojan horse, time bomb or any other instructions or code designed to distort, delete, damage, emulate or disassemble the Software, communications or protocols;
  3. send any communication that is unsolicited (also known as “SPAM” or “SPIT”) or that is not permitted by applicable laws, or use the Software or Products for the purposes of phishing, pharming, to impersonate another person or misrepresent your affiliation with another person or entity;
  4. expose any third party to material that is offensive, harmful to minors, indecent or otherwise objectionable;
  5. use the FijoVirtual Software or Websites to cause or attempt to cause embarrassment or distress, or threaten, harass or invade the privacy of others;
  6. use (including as part of the username or profile image) material or content subject to any third-party proprietary rights, unless you have a license or permission granted by the owner of such rights;
  7. collect or collect any type of information that may identify the user, including account names, from the FijoVirtual Website;
  8. affect or attempt to affect the availability of the Software; for example, through denial of service (DOS) attack or distributed denial of services (DDoS) attack;
  9. use or launch any automated system, including, but not limited to, robots, spiders or offline readers that have access to the FijoVirtual Website. Notwithstanding the foregoing, you agree that FijoVirtual grants the operators of public search engines permission to use spiders to copy materials from the FijoVirtual Website for the sole purpose of creating searchable indices of the publicly available materials, but not caches or archives of such materials. FijoVirtual reserves the right to revoke these exceptions at any time.
  10. User Submissions. Please proceed with respect when participating in any of the features of the FijoVirtual Software or Websites, such as forums, blogs, comments, or any other feature of the FijoVirtual Websites or the FijoVirtual Software that allows you to submit, post, upload, modify, organize, share or publish content. You acknowledge and agree that: (i) by using the FijoVirtual Websites you may be exposed to content that you may find offensive or indecent and you will bear all risks arising from such use; (ii) you will be solely responsible, and FijoVirtual has no liability whatsoever to you or any other third party, for any User Submission that you create, submit or post on the FijoVirtual Websites; (iii) FijoVirtual does not guarantee any type of confidentiality with respect to User Submissions, whether published or not; (iv) FijoVirtual is not responsible for any User Submissions that you may access through the use of the FijoVirtual Websites or the Software, and all User Submissions are the responsibility of the person from whom such User Submissions originated. FijoVirtual does not endorse any User Submission or any opinion, recommendation or advice expressed therein and expressly waives any and all liability related to User Submissions.
    In connection with User Submissions, you represent and warrant that:
  11. owns or has the necessary licenses, rights, consents and permissions to use and authorize FijoVirtual to use all intellectual property rights, trademarks, trade secrets, patents, copyrights or other proprietary rights in all User Submissions as set forth in these Terms; and
  12. has the written consent, release or permission of each and every identifiable individual person in the User Submissions to use the name or faithful reproduction of each such individual person included in the User Submission to enable inclusion and use of the User Submissions in the manner contemplated by these Terms. You may not copy, publish or use text, photographs, images, music, sounds or other content from third parties or other sources (“Third Party Content”) without specific authorization from the owner. Such Third Party Content may be protected by intellectual property laws and the owners of those rights may object to its use. You must not use any Third Party Content without first obtaining permission from the owner of the intellectual property rights of such content.
  13. Notwithstanding the rights and obligations governed by the Additional Terms (as defined below), if at any time you decide to upload or post User Submissions to the FijoVirtual Websites (except for Reports and the content of your communications), you automatically grant FijoVirtual a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable, perpetual license of all rights to use, modify, include, incorporate, adapt, register, publicly perform, display, transmit and reproduce the User Submissions (such as, but not limited to, all related trademarks, in connection with the FijoVirtual Websites and the FijoVirtual Software and Products including, for the purpose of promoting or redistributing part or all of the FijoVirtual Websites or the Software or Products, in all media now known or developed in the future). You also hereby grant each user of the Website or the FijoVirtual Software or Products a non-exclusive license to access your User Submissions through the Website or the FijoVirtual Software or Products and to prepare derivative works of the User Submissions, use, copy, distribute, display, perform and transmit such User Submissions solely as permitted by the functionality of the FijoVirtual Websites, Software or Products and in accordance with these Terms of Use. Additionally, you waive any so-called “moral rights” related to User Submissions, to the extent permitted by applicable laws.
  14. You may not submit or publish through the FijoVirtual Website or the Software any User Submission that is defamatory, pornographic, harassing, aggressive, obscene, invasive of privacy, insulting, illegal, racist, offensive, harmful to a minor, or that violates intellectual property rights or a trade secret of third parties, or would violate the rights of third parties or give rise to civil and criminal liability. Additionally, you may not send or post any User Submissions that contain falsehoods or misleading statements, solicit funds or services, contain advertising, promotional materials, spam, spam, chain mail, or any other unsolicited action; impersonate others or include programs that contain viruses or any other programs designed to weaken the functionality of any computer. You further agree not to offer services or merchandise, for commercial purposes, to any user of the Website or the FijoVirtual Software in connection with User Submissions. You agree not to circumvent, disable or otherwise interfere with security-related features of the Website or the FijoVirtual Software or features that prevent or restrict the use of any content.
  15. Your information. From time to time, FijoVirtual may request information from you for the purpose of providing the Software or Products to you. You must ensure that the information is complete, up-to-date, and correct.
  16. Resale not permitted. The Software and Products are for personal use. You will not resell or market the Software or Products to any third party.
  17. Export restrictions. The Software may be subject to international rules governing the export of software. You must comply with all applicable national and international laws applicable to the Software, and you must also comply with destination, end-use, end-user and country embargo restrictions issued by national governments or similar bodies.

7. PROPERTY RIGHTS

  1. The FijoVirtual Software, Products and Websites contain confidential and proprietary information that is protected by intellectual property laws and treaties.
  2. The content and compilation of content included on the FijoVirtual Websites (excluding User Submissions), such as sounds, text, graphics, logos, icons, images, audio clips, digital downloads and software, are the property of FijoVirtual, its affiliates or licensors, and are protected by intellectual property laws. Said content protected by intellectual property laws may not be reproduced without the express authorization of FijoVirtual.
  3. FijoVirtual or its licensors retain exclusive ownership of the FijoVirtual Software, Products and Websites, and all intellectual property therein (whether registered or unregistered, and anywhere in the world). You may not take any action that jeopardizes, limits or interferes with the intellectual property rights of the Software, Products or FijoVirtual Websites.
  4. FijoVirtual, related trademarks and logos are trademarks of FijoVirtual. FijoVirtual’s trademarks and trade dress may not be used in connection with any product or service that is not FijoVirtual’s, in any manner that is likely to cause confusion among customers, or in any manner that discredits or discredits FijoVirtual. All other trademarks not belonging to FijoVirtual or its related companies appearing on this site are the property of their respective owners. You cannot and must not register any trade name, trademark, logo, domain name or other names or signs that incorporate any of FijoVirtual’s intellectual property rights (in whole or in part), or that are very similar.

8. CHARGES

  1. Calls received on the user’s phone with special rates with FijoVirtual credit.
  2. Calls received on landlines and mobile phones within the countries supported by FijoVirtual. Charges for calls to telephones (outside of a plan) consist of a per minute rate, as established in call forwarding rates and on the page of each country of the virtual number concerned (for example Spain , etc.
  3. FijoVirtual may change the rates at any time and without prior notice, by publishing such modification on  call forwarding rates and onand on the page each country for the virtual number concerned (for example Spain , etc. . The new rate will be applied to your next purchase after the new rates have been posted. Before you receive a call, check the latest rates. If you do not accept the new rates, do not make the call.
  4. Call durations are calculated in one-minute increments. The fraction of a minute (even if it is a second) will be rounded up to the next minute. Fractional usage charges will be billed in increments that are rounded, for example, a charge of €0.039 will be charged to €0.04. During the call, charges incurred will be automatically deducted from your FijoVirtual credit balance in your User Account.
  5. Tool-free numbers (commonly called toll-free numbers 900, 901, 902, or 800 in Spain) have additional charges for incoming calls that are counted per minute of call reception. Please check current prices as variations may occur without prior notice.
  6. Charges for other non-free products. Charges for other Non-Free Products will be confirmed to you before completing a purchase from FijoVirtual. FijoVirtual may change the charges payable for the purchase of such Products at any time without prior notice. You may choose whether or not to accept the new charges before completing your next purchase of the applicable Product. The new charges will be applied to your next purchase after the new rates have been posted.
  7. Promotional Offers. From time to time, FijoVirtual offers Non-Free Products free of charge for a trial period. FijoVirtual reserves the right to charge you for such Products (at the normal rate) in the event that FijoVirtual determines (in its sole discretion) that you are abusing the terms of the offer, including your use of any service, proxy or other device or anonymous IP address that does not allow us to locate you.
  8. Taxes. The 21% VAT rate in Spain normally applies to EU residents and also if you do not have a VAT registration number. FijoVirtual reserves the right to apply VAT at the applicable rate under the VAT regulations in force at the time of purchase. Depending on the country, local VAT or other taxes may be charged when purchasing a voucher, which may be deducted from the value of the voucher at the time of redemption. When requesting an invoice, you must take into account that the current taxes will be applied to it in accordance with Spanish VAT and/or Personal Income Tax legislation, these taxes will be billed to your account. Invoices will appear for virtual fixed software maintenance service.
  9. Third party charges. In case of use of Software in mobile applications, it will use part of the available data limit of the data package to which you subscribed with your mobile network operator. Out-of-country use may result in significantly higher charges than regular usage, and you are solely responsible for staying informed and paying any applicable roaming and other charges charged by your mobile network operator.
  10. As it is a prepaid service, invoices will not be issued automatically.
  11. The minimum information to formalize the contract is Name, Surname, email and Password. Some additional information may be required in some countries. Consult us.
  12. If the Client is a company or self-employed person and wants to receive an invoice, they must inform FijoVirtual in writing of the necessary billing information; User code, name or company name, CIF/ NIF/ NIE, telephone, address and postal code. To do this, you have a contact form in your private area to do so (Invoice Request). 
  13. Invoices are issued only quarterly as long as point 12 above has been met and from that date of registration of invoice sending (record of point 12 and never before), invoices are issued quarterly between December 15 to January 15, March 15 to April 15, June 15 to July 15, and September 15 to September 15. October. These invoices will appear with a date that coincides with the date it was sent and never with a date before or after it. These will show the sum of amounts paid for “Computer Services” that correspond to the recharges or payments made in the previous quarter.
  14. Charges may be established in case of portability of your number, both incoming and outgoing portability to another provider. These must be communicated one week in advance via email, the cost will depend on the country and area of the number and will be informed at the time of communication. For new hires, you must wait 6 months before being able to port to another provider. In cases of incoming portability, even if it is reported that it is free, if in the middle of the portability you decide to cancel it, charges may arise for canceling the portability, these charges will be informed to you via email at the time of production.

9. PAYMENT

  1. FijoVirtual Credit. You can pay for certain Non-Free Products with FijoVirtual credit. You may purchase credit from FijoVirtual using any payment method that FijoVirtual provides from time to time. The FijoVirtual credit you purchase will be credited to your User Account at the time of purchase (or if you are using a FijoVirtual credit voucher, at the time you redeem the voucher). The credit is valid for one year and is not reset at the end of the month.
  2. FijoVirtual credit associated with subscription. For the call receiving service, the user subscribes to obtain a number. Associated with the monthly payment, FijoVirtual offers an initial balance according to the offer (see current conditions in fijovirtual.com ). This type of credit is valid to maintain the assigned fixed number for one month and a limited number of minutes. At the end of the month, the undepleted balance is reset, with the user having to top up the balance again if they wish to keep the number. The monthly charge is made in subscription mode, and the user commits to this monthly charge when they first purchase the number. The user may cancel their subscription at any time without any penalty at fixedvirtual.com
  3. Subscription payment will be made on the day of the month that the user registered. For registrations on the 29th, 30th and 31st of the month, the renewal will take place on the 1st of the following month. All FijoVirtual renewals are carried out in automatic processes that start at 00:00 (Spanish Time), some delay is possible in this update but it will not affect the user experience.
  4. Inactive FijoVirtual credit. If you do not use your FijoVirtual credit for 365 days, FijoVirtual will mark that credit as inactive. You cannot use FijoVirtual credit on or after its expiry date.
  5. Other forms of payment. FijoVirtual does not guarantee that you will be able to use your FijoVirtual credit balance to purchase any Product. When FijoVirtual credit cannot be used to pay for a Product, FijoVirtual will offer you another form of payment. FijoVirtual reserves the right to remove or modify available payment methods at its sole discretion.
  6. Recurring payments. If you purchase Products with a plan on a monthly basis, you acknowledge and agree that this is a recurring payment, and that payments must be made to FijoVirtual in the manner you have chosen, at the applicable recurring intervals, until you or FijoVirtual cancel the plan.
  7. If the charge is rejected by your bank or intermediary, FijoVirtual reserves the right to cancel the service. The user will be notified of said return and FijoVirtual will do everything possible to maintain its services if the user corrects the collection problem.

    Automatic recharge:
  8. The Automatic Recharge feature allows you to automatically recharge your FijoVirtual Credit (as defined in 9.a) if it falls below a certain amount by adding the same amount and with the same payment method that you chose when you first subscribed to Automatic Recharge, unless you later change the amount by logging into your User Account. For example, if you purchase €10 of FijoVirtual credit with your credit card, the top-up amount that will be charged to your credit card will also be €10 of FijoVirtual credit. In the future, this same amount will be charged to your credit card each time your FijoVirtual account balance falls below the limit established by FijoVirtual from time to time.
  9. You can disable Automatic Recharge at any time by logging into your User Account.

    Safety information
  10. All payments are made securely.
  11. Card details are entered securely on a page with an SSL certificate.
  12. Credit card details are transmitted to the company that manages credit card payments securely, using an SSL certificate.
  13. The company in charge of managing payments is the one who carries out security checks, authorization and authentication of the credit or debit card.
  14. FijoVirtual does not save, at any time, credit or debit card data on its servers.

10. REFUND POLICY

  1. FijoVirtual credit or a balance in your favour. You CANNOT request a refund of any FijoVirtual credit or balance remaining in your User Account under any circumstances, even if the balance is active or associated with a subscription.
  2. FijoVirtual will NOT refund any payment made for any Non-Free Product whether or not it is FijoVirtual credit.
  3. Non-Refundable Purchases. No refunds will be made for (a) reactivated FijoVirtual credit; (b) Non-Free Products (including FijoVirtual credit) that a FijoVirtual Manager administrator pays for and assigns to your User Account; (c) Products (including FijoVirtual credit) that are not purchased directly from FijoVirtual via the Internet (e.g., vouchers or prepaid cards) or that are paid in cash with third-party payment methods (e.g., electronic cash payment wallet).
  4. Free Products. In the event of allocation of free credit, such as an offer or a trial number, FijoVirtual reserves the right to withdraw it when it deems appropriate. This credit is the property of FijoVirtual and is only assigned to be able to test the service.
  5. Payment by mistake. If you believe that FijoVirtual has charged you in error, you must contact FijoVirtual within 30 days of the charge being made. No refunds will be made if more than 30 days have passed since payment.
  6. FijoVirtual reserves the right to reject a refund request if it reasonably believes (a) that you are unfairly exploiting this refund policy, for example, if you make repeated refund requests in respect of the same Product; (b) if you do not comply with these Conditions or (c) if FijoVirtual reasonably suspects that you are using our Products or our Software fraudulently or that your User Account is being used fraudulently by third parties.
  7. Refund payments will be made in the same way you initially made the payment.
  8. This refund policy does not affect your legal rights.

11. TERMINATION OF YOUR RELATIONSHIP WITH FijoVirtual

  1. You may terminate your relationship with FijoVirtual at any time and without resorting to court by requesting the closure of your User Account, ceasing to use the FijoVirtual Software, Products or Websites, and canceling all recurring payments.

    FijoVirtual may terminate its relationship with you, or terminate or suspend your use of the Software, User Account(s), Products or FijoVirtual Websites at any time and without resorting to court:
  2. if you do not comply with these Conditions;
  3. If you do not have balance in the account to renew the virtual landline or to forward or receive calls.
  4. if you make a request for a refund of a payment through the payment methods and not with us, if you reverse a payment, or fraud a payment, regardless of whether you have a balance in your account and have additionally made other payments.
  5. if FijoVirtual reasonably suspects that you are using the FijoVirtual Software, Products or Websites, and do not comply with laws or violate the rights of third parties;
  6. if FijoVirtual reasonably suspects that you are attempting to unfairly exploit or misuse the refund policy, or any of our policies;
  7. if FijoVirtual suspects that you are using the FijoVirtual Products, Software or Websites fraudulently or that your User Account is being used by third parties fraudulently;
  8. if you do not provide the verification documentation requested by FijoVirtual within the indicated period, if the documentation provided is insufficient, false, inaccurate, illegible or does not allow to correctly verify the identity, address, ownership, representation, activity or compliance with the requirements applicable to the service;
  9. with respect to a particular Product, with thirty (30) days prior notice, if FijoVirtual decides to stop offering that Product;
  10. immediately, if required by a change in laws/regulations by a regulator or legal authority, or by any partner of FijoVirtual;
  11. with thirty (30) days prior notice, if FijoVirtual decides to stop offering the Software to users in your jurisdiction generally.
  12. FijoVirtual will give effect to such termination by preventing you from accessing your User Account, the Software, the Products or the FijoVirtual Websites (as applicable). We reserve the right to cancel User Accounts that have been inactive for more than one (1) year.
  13. Consequences of termination. Upon termination of your relationship with FijoVirtual: (a) all licenses and rights relating to the use of the FijoVirtual Software, Products or Websites will terminate immediately; (b) you will immediately discontinue all use of the FijoVirtual Software, Products or Websites; and (c) you will uninstall the Software from all hard drives, networks and other storage media, and destroy all copies of the Software in your possession or control immediately.
  14. In case of non-correct presentation of the documentation KYC/AML and local requirements (e.g. proof of address in the country of numbering) before or during service.

12. EXCLUSION OF WARRANTIES, LIMITATION OF LIABILITY AND INDEMNIFICATION

  1. For the purposes of this paragraph 12, “FijoVirtual” includes its subsidiary companies, affiliated legal entities and all of its directors, officers, agents, licensors and employees.
  2. Absence of guarantees. TO THE EXTENT PERMITTED BY APPLICABLE LAW: THE SOFTWARE, PRODUCTS AND WEBSITES OF FijoVirtual ARE PROVIDED AS IS WITH ALL RISKS ARISING OUT OF USE WITHOUT WARRANTIES OF ANY KIND. FijoVirtual MAKES NO WARRANTIES, REPRESENTATIONS OR WARRANTIES AND EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, SWORN, REGARDING THE SOFTWARE, PRODUCTS OR WEBSITES OF FijoVirtual, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OR CONDITIONS OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR USE FOR PARTICULAR PURPOSES. FURTHERMORE, FijoVirtual DOES NOT REPRESENT OR WARRANT THAT THE SOFTWARE, PRODUCTS OR WEBSITES OF FijoVirtual WILL ALWAYS BE AVAILABLE, ACCESSIBLE OR COMPLETE OR THAT THEY WILL BE SECURE OR ACCURATE. NOR DOES IT REPRESENT OR WARRANT THAT THEY WILL BE FREE OF INTERRUPTIONS OR DELAYS, OR THAT THEY WILL BE ERROR-FREE OR THAT THEY WILL OPERATE WITHOUT PACKET LOSS. FijoVirtual ALSO DOES NOT GUARANTEE CONNECTIONS OR TRANSMISSIONS FROM OR TO THE INTERNET, OR THE QUALITY OF CALLS MADE THROUGH THE SOFTWARE.
  3. Nothing in these Conditions shall exclude or restrict FijoVirtual’s liability arising from (a) death or personal injury, (b) loss resulting from an intentional act or gross negligence on the part of FijoVirtual, (c) fraud or malicious misrepresentation, or (d) any liability that cannot be limited or excluded under applicable law.
  4. Disclaimer. YOU ACKNOWLEDGE AND AGREE THAT FijoVirtual SHALL HAVE NO LIABILITY WHATSOEVER, (WHETHER IN CONTRACT, TORT, [INCLUDING NEGLIGENCE] OR ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGE OR LOSS HAS BEEN NOTIFIED TO FijoVirtual), ARISING OR RELATES TO YOUR USE OF THE FijoVirtual WEBSITES, OR INTERNET COMMUNICATIONS SOFTWARE OR OTHER SOFTWARE PROVIDED FREE OF CHARGE. YOUR ONLY LEGAL RIGHT OR REMEDY FOR ANY PROBLEM OR DISSATISFACTION WITH THE FijoVirtual SOFTWARE OR WEBSITES IS TO UNINSTALL AND STOP USING THE FijoVirtual SOFTWARE OR WEBSITES IMMEDIATELY.
  5. Limitation of liability. Subject to paragraphs 12.3 and 12.4 above, FijoVirtual shall not be liable to you, whether in contract, tort (including negligence) or any other theory of liability, and whether or not FijoVirtual has been notified of the possibility of such damage or loss, by:
  6. no indirect, special, incidental or consequential damages;
  7. any loss of income, business opportunities, current or anticipated profits, opportunities, goodwill or reputation (whether direct or indirect);
  8. no damage or alteration of data (whether direct or indirect);
  9. no claim, damage or loss (whether direct or indirect) arising out of or in connection with:
  10. your inability to use the Software to communicate with emergency services;
  11. your failure to take additional steps to access emergency services as set forth in the paragraph above;
  12. your failure to provide correct information about your physical location to an emergency services agent;
  13. the performance of third-party emergency service agents and the call to centers with which you may be in contact.
  14. no claim, damage or loss (whether direct or indirect) arising out of or in connection with:
  15. any products or services provided by third parties under their own terms of service, including, but not limited to, FijoVirtual Access;
  16. no third-party technology;
  17. no third-party websites.
  18. Subject to paragraphs 12.3 – 12.5 above, FijoVirtual’s total liability to you under these Conditions (whether in contract, tort (including negligence) or other theory of liability) SHALL NOT EXCEED IN THE AGGREGATE THE AMOUNT PAID BY YOU FOR THE PRODUCTS IN THE 12 MONTHS PRIOR TO THE DATE OF THE EVENT YOU GIVE PLACE THE PERTINENT CLAIM, SUBJECT TO A MAXIMUM OF FOUR THOUSAND EUROS IN ALL CASES.
  19. If any third party files a claim with FijoVirtual that is related to (i) your breach of these Conditions; (ii) your failure to comply with any applicable law or regulation; (iii) your violation of the rights of third parties (including intellectual property rights); (iv) your User Submissions or (v) your claim relating to any User Submission, or arising from the foregoing, you will indemnify and hold FijoVirtual harmless from and against any damages, liabilities, losses, charges and expenses (including legal fees and expenses) related to such claim.

13. PRODUCTS AND SERVICES OF THIRD PARTY WEBSITES

  1. Third parties may offer products and services through the Software or FijoVirtual Websites, including games, applications, images, ringtones or avatars. While FijoVirtual is not responsible for such products or services, if you have any problems with payment or downloading, using or installing such products or services, FijoVirtual will use commercially reasonable efforts to assist or resolve the problems. Third party products or services may be subject to the third party provider’s terms and privacy policy which you must accept during download or installation. You should review such conditions before making any purchase or using any third-party product or service, and FijoVirtual will not be liable if you fail to do so.
  2. You acknowledge and agree that information and prices for third-party products appearing on the FijoVirtual Websites relating to third-party products and services are provided to FijoVirtual by the applicable non-FijoVirtual merchant (“Merchant”). The Merchant may change prices or end the availability of products at any time. FijoVirtual is not involved in the transactions between you and any Merchant whose products or services are found on the FijoVirtual Websites. FijoVirtual does not control, guarantee and is not responsible for: (i) the price, quality, operation, availability or the terms and conditions of purchase of the products or services provided by the Merchant; (ii) any payment, delivery, return or after-sales activity related to products or services purchased on the Merchants’ websites; (iii) the availability of the Merchant’s websites; (iv) the completeness, truthfulness or accuracy of any advertising or other materials found or available on the Merchants’ websites or any listing or other content about those products and services that appear on the FijoVirtual Websites; (v) the links to the Merchants’ websites that appear on the FijoVirtual Websites. Questions, complaints or claims regarding any product or service provided by a Merchant should be directed to the applicable Merchant.
  3. The FijoVirtual Software and Websites may include hyperlinks to other third-party websites. FijoVirtual is not responsible for such third party websites or the availability of such websites, nor does it endorse any content or materials on such third party websites. Your use of each of these third-party websites is subject to the terms and conditions posted on the relevant website.

14. YOUR CONFIDENTIAL INFORMATION AND YOUR PRIVACY

  • FijoVirtual is committed to respecting the privacy and confidentiality of your personal information. We will process your personal information, identification data, contractual data, billing data, traffic data, verification/KYC documentation and other data necessary to provide the service in accordance with our Privacy Policy:

15. HOW TO COMMUNICATE WITH FijoVirtual

  1. To contact FijoVirtual regarding the FijoVirtual Software or “FijoVirtual” branded Products, please submit a support request to info@fijovirtual.com
  2. If you contact FijoVirtual by any means other than those stipulated in the previous paragraph, your request may not be accepted.

16. MISCELLANEOUS

  1. You agree to the use of electronic communication for the execution of contracts, the placing of orders and the creation of other records, as well as for the electronic distribution of notifications, policies, changes to them and records of operations with FijoVirtual.
  2. For your convenience, FijoVirtual may provide you with a translation of the English version of these Terms. In the event of any discrepancy between a non-English version of these Terms and the English version, the Spanish version will govern your relationship with FijoVirtual.
  3. These Terms constitute the entire agreement between you and FijoVirtual with respect to your use of the FijoVirtual Software, Products or Websites, and supersede all prior agreements between FijoVirtual and you with respect to the FijoVirtual Software, Products or Websites.
  4. If any provision of these Terms (or any part of a provision) is determined by any court or administrative body of competent jurisdiction to be illegal, invalid or unenforceable, such provision (or part thereof) will be severed from the Terms without affecting the legality, validity or enforceability of the remainder of the Terms.
  5. The lack of exercise, by FijoVirtual, or the delay in exercising a right or remedy provided for by the Conditions or by legislation will not constitute a waiver by FijoVirtual of such right or remedy. If FijoVirtual waives its claim for breach of these Conditions, this will not constitute a waiver of its claim for subsequent breaches of the Conditions.
  6. You may not assign these Conditions or any rights or obligations they include. FijoVirtual may, without prior notice, assign these Conditions or any rights or obligations they include to third parties.
  7. You acknowledge and understand that if FijoVirtual is unable to provide the FijoVirtual Software, Products or Websites as a result of a force majeure event, FijoVirtual will not be in breach of any of its obligations to you under these Conditions. A force majeure situation refers to any event beyond the control of FijoVirtual.
  8. Offers must be claimed via email for them to be applied and valid. If the client does not claim the offer within the month, they expire and can no longer be claimed or granted. The offer begins to count from the moment the purchase occurs. Offers are for a limited time. We reserve the right to remove or change any or all offers at any time and without prior notice. We reserve the right to grant or not grant offers to clients when we deem appropriate whether or not they meet the requested requirements. To benefit from the offers you must meet the requirements requested in the offers section.
  9. These Conditions will be governed and interpreted in accordance with the laws of Spain, and will be subject to the jurisdiction of the courts.

17. SPECIFIC CONDITIONS OF THE PRODUCTS

  1. Geographic numbers of FijoVirtual

    Availability and use. When we provide you with a FijoVirtual geographic number, you agree that:
  2. you do not own the number and have no right to keep it forever;
  3. the number we provide to you is subject to numbering regulations and regulatory practices;
  4. you will permanently comply with any specific number allocation requirements that we make known to you, or with any reasonable instructions that FijoVirtual or FijoVirtual’s partners may give to you in relation to the use of the numbers and the Products;
  5. you will not transfer or attempt to transfer your number to third parties. In particular, you are responsible for compliance with all requirements related to residency or location; and all the requirements imposed on us by the administrations of each country of your contracted virtual landline, and we cannot be held responsible for decisions made by these states.
  6. you will provide us with accurate, complete and updated information upon request and will notify us if such information changes. FijoVirtual reserves the right to change the conditions relating to Geographic Numbers, including, but not limited to, imposing or correcting any residency requirement or providing additional user information for continued access to such numbers. In some countries, a FijoVirtual partner, rather than FijoVirtual, may be responsible for making the number available to you and you may be required to enter into a separate contract with that partner.
  7. Other changes to numbers. If FijoVirtual needs to withdraw or change the number that has been provided to you, FijoVirtual will use commercially reasonable efforts to notify you by email, indicating the effective date of the change, and if possible, your new number. If you do not wish to accept this new number, you have the right to cancel your number.

    Plans.
  8. Fair use. Plans are subject to reasonable usage. At this time we do not have any policy published, but FijoVirtual reserves the right to modify this point when it deems appropriate.
  9. Plans are for personal use only. Each plan must be used by one person only and must not be shared with any other user (whether through a PBX system, call center, computer or by any other means). Each plan should be used for personal communication purposes only, to make calls to another person. You are prohibited from using the plan for commercial purposes, such as calling numbers for the specific purpose of generating income for yourself or others. Unusual calling patterns may be considered an indication of such use and may result in termination of your plan and blocking of your User Account.
  10.  FijoVirtual reserves the right to withdraw or modify plans at any time. If FijoVirtual modifies the Products included in your plan, FijoVirtual will notify you by email of the modifications and their effective date. If you do not wish to accept these modifications, you have the right to cancel your plan, which will take effect from the date on which the modifications are to come into effect.

YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND UNDERSTAND THE RIGHTS, OBLIGATIONS, CLAUSES AND CONDITIONS STATED HEREIN.
